Abstract

The article addresses the difficulties and shortcomings in the implementation of the New Public Education Law in Chile (Law No. 21,040). Three specific objectives are established to achieve this general objective: to describe the context of the development and implementation of the law, to explain the purpose of the New Public Education law, and to analyze the results of its implementation. Regarding the context of the development and implementation of the law, the year 2017 stands out as a key period in which the bill was presented, seeking to improve the quality and management of public educational establishments in the country, replacing the municipalized system. The purpose of the New Public Education Law was to strengthen public education, guarantee equal opportunities, and improve teacher training. It sought to grant greater autonomy to educational establishments, establish quality standards, and promote the participation of the educational community. However, the implementation of the law has faced difficulties and shortcomings. Controversies and debates have arisen around decentralization, citizen participation, and educational quality. The selection of school principals through public competitions, the deconstruction of the unequal municipal management of public education, and the teacher development system have been points of discussion in the social and political arena.
